Terms and Conditions

Please read these Terms and Conditions in its entirety
and choose I Agree or I Do Not Agree at the bottom.
All users of our service will be bound by this agreement.

THIS AGREEMENT:
is made between MagaDraw and Client of services offered by
MagaDraw.

Each Pool Owner must have a Team Name and the Name of the
person owning the Team. If the pool you join has an entry
fee, it is the sole responsibility of the Pool Manager to
collect. MagaDraw is not a collection agency and will not
be liable for any monies owed to the Pool Manager.

TERMINATION:
Either party has the right to terminate this agreement at
any time without prior notice and without cause.
If MagaDraw is given cause to believe that
the client has, will be, or is using the services of
MagaDraw for questionable or outright illegal
activities, MagaDraw reserves the right to
terminate this entire service agreement immediately
without notification to client.

SERVICE TO BE PROVIDED BY MagaDraw:
During the term of this agreement, MagaDraw
will provide an accurate and up to date Golfer Database
listed online.

IMPORTANT DOWN TIME:
There MAY be a period of up to four weeks during the summer 
that the data may not be updated due to being away from the 
country and not being able to access the web.

COMPLIANCE WITH LAW:
Client will use the services offered by
MagaDraw in a responsible manner consistent
with all applicable local, state and federal laws and
regulations.

DISCLAIMER OF WARRANTY:
THE SERVICE IS PROVIDED AS IS WITHOUT WARRANTY OF
ANY KIND. MagaDraw SPECIFICALLY DISCLAIMS
ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE. IN NO EVENT SHALL
MagaDraw BE LIABLE FOR ANY CONSEQUENTIAL,
INDIRECT, SPECIAL OR INCIDENTAL DAMAGES, EVEN IF PROVIDER
HAS BEEN ADVISED BY CLIENT OF THE POSSIBILITY OF SUCH
POTENTIAL LOSS OR DAMAGE. IF MagaDraw's
SERVICE TO CLIENT IS DISRUPTED OR MALFUNCTIONS FOR ANY
REASON, MagaDraw SHALL NOT BE RESPONSIBLE
FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE,
BEYOND THE FEES PAID BY CLIENT TO MagaDraw
FOR SERVICES, DURING THE PERIOD OF DISRUPTION OF
MALFUNCTION.

LIMITATION OF LIABILITY:
MagaDraw IS NOT LIABLE FOR PROTECTION
OR PRIVACY OF ELECTRONIC MAIL OR OTHER INFORMATION
TRANSFERRED THROUGH THE INTERNET OR ANY OTHER NETWORK
MagaDraw OR ITS CUSTOMERS MAY UTILIZE.
MagaDraw DOES NOT REPRESENT OR WARRANT
TO CLIENT THAT CLIENT WILL RECEIVE CONTINUAL AND
UNINTERRUPTED SERVICE DURING THE TERM OF THIS
AGREEMENT. IN NO EVENT SHALL MagaDraw
BE LIABLE TO CLIENT FOR ANY DAMAGES RESULTING FROM OR
RELATED TO ANY FAILURE OR DELAY OF MagaDraw
TO PROVIDE SERVICE UNDER THIS AGREEMENT.

INDEMNITY:
Client agrees to indemnify and hold MagaDraw
harmless from any and all claims, losses, damages,
liabilities, judgements, or settlements, including
reasonable attorney’s fees, costs, and other expenses
incurred by MagaDraw as a result of any
activities conducted by Client.
